Your clients turn to you for your expertise, your advice, and simply to get the job done. You often try to negotiate. You sometimes litigate. Now you are looking to use mediation.
One common misconception about mediation is that it will not provide the best result for your client since it is not an adversarial process. Your client has many interests. One is the outcome of their problem for which they have turned to you for help. But, as experience in negotiating has taught us, they may have many more interests: for example, keeping legal costs down, not setting a precedent, keeping the matter non-public, or maintaining a relationship with the opposing party. Many interests can come together into a complex web of issues that make it difficult for one party or both to effectively negotiate. Mediation is a process that can often help all parties sort through this complex web, even where traditional negotiations have already failed. At the heart of it, mediation never strays from the ultimate goal of reaching a settlement to which everyone can agree.
